Requirements pursuant to Article 12 of EU REGULATION 679/2016 – Information, communications and transparent methods for the exercise of the rights of the interested party – Information pursuant to the Articles 13-14 of EU REGULATION 679/2016

Pursuant to EU Regulation 679/2016 containing “General Data Protection Regulation” (“EU / 679/2016 Regulation”) My Frame S.r.l. (hereinafter the “Company”) as Data Controller, is required to provide you with information regarding the use of your personal data.

The disclosure also refers to treatments carried out by subjects who carry out, on behalf of the Company, the technical or organizational tasks described in paragraph 1.

1. Purposes and methods of processing. Nature of providing data.

The personal data referred to in this statement are data relating to the performance of economic activities connected with the supply of goods or services and are, as a rule, provided directly by the subject to whom the personal data refer (the Interested). Personal data is processed by the Company for the following purposes:

– execution of obligations deriving from contracts stipulated with suppliers and / or fulfillment before the conclusion of the contract, of specific requests of the interested party;
– litigation management;
– fulfillment of obligations imposed by laws, regulations and Community legislation.

For certain services, the Company uses subjects of its own trust who, as independent data controllers, or in some cases as data controllers, perform technical or organizational tasks, such as, for example:

– transmission, transport and sorting of communications;
– provision of administrative and accounting services, documentation storage;
– the provision of data acquisition, recording and processing services deriving from documents or supports provided or originated by the interested parties;
– accounting processing company.

The Company and the subjects referred to in the previous paragraph proceed with the processing of personal data by manual processing or electronic or automated means; according to logic strictly related to the same purposes and in any case in order to guarantee the security and confidentiality of the data.

The provision of your personal data is strictly functional to the establishment and management of the contractual relationship and your refusal may lead – in relation to the relationship between the data and the requested service – to the impossibility for the Company to establish or continue the aforementioned report. Some data, then, must be communicated by you or by third parties for legal or regulatory obligations.

2. Categories of data subject to processing.

In relation to the purposes described in the previous paragraph 1, the Company and the subjects of which it avails treat your personal data relating to:
Company name, address and other elements of personal identification of the legal representative (name and surname, date of birth, tax identification number); fiscal Code; VAT number, bank account identification details (eg IBAN), telephone, FAX, e-mail, PEC.

In the execution of the contractual relationship the Company and the subjects of which it avails do not need to process personal data that the art. 9 of the aforementioned Regulation defines as “particulars” (such as, for example, the personal data suitable to reveal the state of health, political and union opinions, religious beliefs, etc.). For these reasons, we ask you not to disclose this type of data to the Company. However, if the Company, due to its operations, has the need to process data of a “particular” nature, the same will take care to send you a new specific information and the related request for consent to the processing.

3. Categories of subjects to whom the data may be communicated or who can learn about them as data controllers or processors.

For the pursuit of the purposes described in this statement, the Company needs to communicate your personal data to third parties, belonging to the following categories of subjects:
– the subjects who carry out the technical and organizational tasks described in paragraph 1;
– central and peripheral bodies of the Public Administration; Local Authorities and their peripheral bodies; Authorities and Supervisory Bodies, Judicial Authorities, Public Security Authorities; professionals, professional associations, banking and financial intermediaries.

The recipients of the communications described in this information act in total autonomy, as distinct data controllers or, in some cases, have been designated by the Company as data processors. Their list, constantly updated, is available from the Company.
Some categories of people, as data processors, can access your personal data for the purpose of fulfilling the tasks assigned to them. In particular, the Company has appointed its employees as processors of your data, including system administrators, and its collaborators.
Your personal data may also be disclosed, on the occasion of the execution of the tasks assigned to them, also the subjects designated by the Company as data processors.
The personal data processed by the Company and the subjects used by it are not subject to disclosure.

4. Terms of retention of personal data.

Personal data will be processed for the entire duration of the established contractual relationships, and also subsequently, for the fulfillment of all legal obligations and in any case for a period not exceeding 10 years from the establishment of the contractual relationship or beyond in the cases expressly requested From law.

5. Rights of the interested party pursuant to Articles 15 and ss. of EU Regulation 679/2016.

We inform you that the legislation on the protection of personal data gives interested parties the opportunity to exercise specific rights. In particular, each interested party has:

1) the right of access, expressly provided for by the art. 15 of Regulation 679/2016, ie the possibility of accessing all personal information concerning him;
2) the right of rectification, expressly provided for by the art. 16 of Regulation 679/2016, ie the possibility of obtaining the update of inaccurate personal data concerning him without justified delay;
3) the right to oblivion, expressly provided for by the art. 17 of Regulation 679/2016, consisting of the right to cancel personal data concerning the person concerned;
4) the right to limit processing when one of the hypotheses envisaged by art. 18 of Regulation 679/2016;
5) the right to data portability, expressly provided for by the art. 20 of Regulation 679/2016, ie the right to obtain their data in an interoperable format and / or the right to have their personal data transmitted to another data controller without hindrance by this Company;
6) the right to revoke consent at any time, expressly provided for by art. 7 of Regulation 679/2016;
7) the right to lodge a complaint with the Guarantor in the event of a breach in the processing of data pursuant to art. 77 of Regulation 679/2016;
8) the right to appeal to the courts in the event of unlawful processing of the data, even against the acts undertaken by the Guarantor pursuant to Article 78 of Regulation 679/2016;
9) the right to object at any time to the processing by sending commercial communications and advertising or direct sales material, by sending an e-mail to the address info@telailosa.com, expressly requesting the cancellation of one’s names from the advertising list.
